These Terms of Service (“Terms”) govern your access to and use of the Pixnugget website, including our artwork pages, print order pages, digital product links, contact forms, newsletter forms, and any related content or services provided through the website. By using this website, placing an order, submitting a form, or purchasing a product through one of our linked platforms, you agree to these Terms. If you do not agree with these Terms, please do not use the website.
1. About Pixnugget
Pixnugget is a small creative project focused on poster art, graphic prints, visual atmosphere, abstract composition, typography, color, and wall decor for modern spaces.
Our website may include physical print options, artwork information, digital download links, marketplace links, contact forms, newsletter forms, and related project content.
2. Website Use
You may use this website for personal, non-commercial browsing, viewing artwork, reading product information, placing orders where available, contacting us, or accessing linked marketplace pages.
You agree not to use the website in a way that could damage, disable, overload, interfere with, or compromise the website, its security, its content, or other users’ access.
You also agree not to copy, scrape, reproduce, redistribute, resell, modify, or commercially exploit website content, artwork, images, product mockups, text, or design elements without written permission.
3. Artwork and Product Information
We try to present artwork, product descriptions, sizes, materials, colors, prices, and availability as accurately as possible.
However, minor differences may occur between screen previews and final printed products. Color, contrast, brightness, and detail can vary depending on screen settings, device calibration, paper type, print process, lighting, and production method.
Product availability, sizes, frame options, shipping destinations, prices, and delivery estimates may change over time.
4. Physical Prints
Physical prints are produced to order through third-party print and fulfillment partners.
When you place an order for a physical print, the artwork is produced in the selected size and format after the order is confirmed. Products may be available as unframed poster prints or framed poster prints, depending on the selected artwork, size, destination, and current availability.
Our standard direct-order poster prints are premium poster prints designed for wall decor and interior use. They are not sold as limited museum-grade editions unless clearly stated otherwise on a specific product page.
5. Paper, Frames, and Materials
Our standard direct-order poster prints are produced on premium matte paper, 200 gsm, unless a different material is clearly stated on the relevant product page.
Framed options may include a wooden frame, plexiglass protection, and a hanging kit or mounting system, depending on the product, size, region, and fulfillment partner.
Minor differences in frame appearance, material details, packaging, and mounting components may occur between regions because production and fulfillment may be handled through a global partner network.
6. Sizes and Cropping
We offer selected sizes and ratios to help preserve the intended artwork composition.
Some artworks may include intentional white space, margins, borders, or visual breathing room as part of the design. These elements are not necessarily printing errors.
Not every artwork is available in every size or format. Some sizes may be excluded to avoid awkward cropping, stretching, or changes to the original composition.
7. Orders and Payment
Orders may be processed through third-party checkout providers, payment processors, marketplace platforms, or e-commerce tools.
When you place an order, you agree to provide accurate and complete information, including your name, email address, shipping address, billing details, and any other information required to complete the order.
Payment processing may be handled by a third-party payment provider. Pixnugget does not store full payment card details unless clearly stated otherwise by the relevant checkout system.
An order is not confirmed until payment has been successfully completed and the order has been accepted by the relevant checkout or order system.
8. Third-Party Checkout and Payment Providers
Disclaimer
This store is integrated with the Western Bid™ e-commerce platform, and Western Bid, Inc. is the Merchant of Record for all purchases made in this store. Therefore, you will see “WESTERN BID” listed as the payee on your PayPal account and credit card statement.
We may use third-party services to process payments, manage checkout, calculate shipping, collect taxes, issue confirmations, or process orders.
These providers may have their own terms, privacy policies, buyer protection rules, payment methods, refund procedures, and dispute processes.
By completing a purchase through a third-party checkout or marketplace, you may also be agreeing to that provider’s terms and policies.
9. Shipping and Delivery
We ship physical products internationally through third-party production and delivery networks where available.
Free Shipping is included with direct print orders placed through Pixnugget. Shipping availability and delivery method may depend on the selected product, size, frame option, destination, and current fulfillment conditions.
Orders are usually routed to a suitable production or fulfillment partner based on destination, product type, stock availability, production capacity, and logistics. Whenever possible, production may be handled close to the delivery destination, but this is not guaranteed for every order.
Delivery times vary by destination and local carrier. International delivery may take several weeks in some cases. Delivery dates are estimates and are not guaranteed unless clearly stated otherwise.
10. Customs, Duties, and Taxes
By placing an order, the Buyer acknowledges and agrees that any customs duties, import taxes, value-added taxes (VAT), goods and services taxes (GST), brokerage fees, customs clearance fees, handling fees, and any other governmental or carrier-imposed charges arising from the importation of the purchased goods into the destination country (collectively, the "Import Charges") shall be the sole responsibility of the Buyer.
Unless expressly stated otherwise in the product listing, checkout page, shipping method description, or order confirmation, all orders are shipped on a duties-and-taxes-unpaid basis, and Import Charges are not included in the purchase price or shipping charges paid to the Seller.
Where a product listing, shipping method, or checkout process explicitly states that duties and taxes are included in the purchase price or shipping cost (DDP – Delivered Duty Paid), the applicable Import Charges will be paid by the Seller on behalf of the Buyer to the extent specified in such offer.
The Buyer agrees to timely pay all applicable Import Charges required for customs clearance and delivery of the goods. Failure or refusal to pay such charges may result in delays, storage fees, return of the shipment, abandonment, destruction of the goods, or other actions taken by customs authorities or carriers.
To the fullest extent permitted by applicable law, if the Buyer refuses delivery, fails to pay Import Charges, or otherwise causes the shipment to be returned, abandoned, or destroyed, the Seller shall have no obligation to refund any amounts paid for the goods, shipping costs, customs charges, return shipping fees, storage fees, handling fees, or any other costs incurred in connection with the order.
The Seller shall not be liable for any delays, additional costs, penalties, confiscations, or other actions taken by customs authorities or governmental agencies in the destination country.
11. Incorrect Shipping Information
You are responsible for providing a correct and complete shipping address.
If an order is delayed, returned, lost, or disposed of because of an incorrect or incomplete address, refusal of delivery, failure to collect a package, or failure to follow carrier instructions, a free replacement may not be available.
If you notice an address mistake after placing an order, please contact us as soon as possible. Address changes may not be possible once production or fulfillment has started.
12. Made-to-Order Products and Returns
Physical prints are made to order. Because each item is produced specifically for the selected order, returns for change of mind, incorrect size selection, wrong address, or other customer-side ordering mistakes are not accepted unless required by applicable law.
This does not affect your rights for damaged, defective, incorrect, or lost orders as described below.
13. Damaged, Defective, Incorrect, or Lost Orders
If your order arrives damaged, defective, incorrect, or is confirmed lost in transit, we will arrange a free replacement when the issue is not caused by customer-side error.
To process a replacement, we may require order details, photos of the item, photos of the packaging, tracking information, or other reasonable evidence of the issue.
Please contact us within 30 days of receiving the order if the item arrives damaged, defective, or incorrect.
For lost orders, please contact us within 30 days of the estimated delivery date.
If carrier tracking shows the package as delivered, but you did not receive it, please first check your delivery address, mailbox, building reception, neighbors, local post office, and shipping carrier. Orders marked as delivered by the carrier may not qualify for a free replacement because non-delivery cannot always be verified after a delivered scan.
14. Digital Downloads
Digital downloads may be available through external marketplace platforms or digital product channels.
Digital products are intended for self-printing, personal wall decor, personal gifts, or other uses allowed by the specific license attached to the product.
Standard personal-use digital downloads may not be resold, redistributed, shared as downloadable files, uploaded to print-on-demand platforms, used as part of another product, or used commercially unless a commercial license is clearly included or purchased separately.
Some marketplace platforms may offer commercial license options for selected digital products. In that case, the license shown on the specific product page or marketplace controls what is allowed.
15. Digital Product Refunds
Digital download purchases are usually handled by the external marketplace or platform where the purchase is made.
Because digital files cannot be physically returned, digital downloads are generally non-refundable once delivered or downloaded, unless the platform’s policy or applicable law provides otherwise.
Please review the product details, file format, size information, and license before purchasing a digital product.
16. External Marketplaces and Platforms
Some artworks may be available through external platforms, marketplaces, digital download stores, or print-on-demand services.
These platforms are separate from Pixnugget and may have their own product formats, prices, materials, checkout systems, shipping rules, refund policies, licenses, and customer support processes.
Pixnugget is not responsible for the operation, policies, payment systems, delivery performance, or platform-specific decisions of third-party marketplaces.
17. Intellectual Property
All artwork, images, designs, graphics, text, product mockups, branding, website layout, and related creative content on this website are owned by Pixnugget or used with appropriate rights.
Purchasing a physical print or digital download does not transfer copyright or ownership of the artwork.
You may not copy, reproduce, modify, distribute, resell, license, mint as an NFT, upload to print-on-demand platforms, use for branding, use in commercial products, or otherwise exploit the artwork without written permission or a clearly stated commercial license.
18. Personal Use of Physical Prints
Physical prints are sold for personal display and decor.
You may display the print in your home, studio, office, workspace, gallery wall, or other personal interior setting.
You may not scan, reproduce, resell, redistribute, or commercially exploit the artwork from a physical print.
19. User Submissions
If you contact us, submit a message, provide feedback, send photos, or share order-related information, you agree that the information you provide is accurate and does not violate the rights of others.
If you share photos of a purchased print in your space, you remain responsible for the content of the photo. We will not use customer photos for marketing unless we have permission.
20. Newsletter and Email Communication
If you subscribe to our newsletter or email updates, we may send you project news, artwork updates, product announcements, marketplace updates, or related creative content.
You can unsubscribe from marketing emails at any time by using the unsubscribe link in the email or contacting us at [email protected].
Order-related emails, support emails, and transactional messages may still be sent when necessary to complete or manage an order.
21. Website Availability
We try to keep the website available and functioning properly, but we do not guarantee uninterrupted, secure, or error-free access.
The website may be updated, paused, changed, or discontinued at any time without notice.
22. Limitation of Liability
To the maximum extent permitted by applicable law, Pixnugget is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website, third-party platforms, products, shipping delays, unavailable products, display differences, or technical issues.
Nothing in these Terms limits any rights you may have under applicable consumer protection laws.
